    Employee Rights in West Virginia

    West Virginia Employee Rights in regards to drugs and alcohol abuse are virtually non-existent with the exception of Federal and state employees. In 2017, the state greatly expanded the rights of employers to conduct drug testing such as urine, saliva, hair analysis, and blood testing. The state’s rationale was that employers have a universal right to prevent, as far as possible, the illegal use of drugs in the workplace. This includes an employee being under the influence at work as it is a risk to other employees and employers. In the expansion of drug testing by the legislature, there were not any considerations or mandating of alcohol and drug treatment policies.

    The court system in West Virginia is allowed to make rulings in favor of addiction treatment or adjudication, should they see fit. Outside the courts, employees struggling with drug and alcohol problems are best advised to carefully read and then call their health insurance policies to see what treatment is available. Many health insurance policies will at least cover some, if all of the cost for treatment. This is true if one requests help prior to any drug or alcohol abuse issues, including the failure of drug tests. Bear in mind though, that in West Virginia, employer cooperation is voluntary, rather than government mandated.

    Maine Employee Rights While In Rehab

    There are Main employee rights in place to protect employees from discrimination and unfair treatment if they need to attend a Maine rehab center. When an employee is going to Maine heroin rehab or to Maine opiate rehab, they don’t have to worry about losing their job. Unless they are using drugs or alcohol while on the clock or if their quality of work performance has suffered their employer has no grounds to fire them. They may need to seek out treatment before they get fired.

    The Family and Medical Leave Act, also known as FMLA, has implemented many Maine employee rights and states that an employer has to grant their employees at least 12 weeks of paid or unpaid leave in a calendar year. If an employee seeks treatment at a Maine rehab center within this timeframe they are well within their rights. There is a formal process to follow in order to attend a Maine addiction recovery while keeping a job, however, and if an employee does not request a leave of absence, they are not protected under this law.

    Filing for Disability in Maine

    The Social Security Administration, or the SSA, offer benefits to employees who can no longer work. In order to file for disability in Maine, an employee must meet the required eligibility requirements. The disability must prevent the employee from being able to work, and it may be necessary to provide medical records, and it will be necessary to complete a physical examination. It is a fairly straightforward process to apply for SSDI benefits online or at a field office, or even over the phone.

    Maine is well-known for its delicious seafood, beautiful seaside and picturesque landscape. It is the travel destination for countless visitors, and if there was only one word to describe it, it would be “breathtaking.” But Maine drug facts show that Maine is also home to a growing number of drug addicts.

    Fentanyl is one of the top killers and Maine and has had an increase in overdoses since 2017. In fact, Maine currently ranks the sixth highest drug-related deaths, which is a sobering statistic in itself.  In 2017 alone, Maine had 418 deaths caused by overdoses which are up from 376 in the year 2016. In 2015 over 50,000 deaths were related to substance abuse and the state governing bodies have identified drug addiction at epidemic levels.

    Synthetic opioids, or heroin, were the cause of over half of these deaths. Part of the reason for the spike is that there is an increased demand for opioids, including prescription medications. Drug traffickers are cutting heroin with more dangerous and deadly substances such as Fentanyl, which is about 100 times more stronger than morphine. Prescription painkillers are often abused, and over half of the overdose deaths in 2015 are directly contributed to opiate and opioid painkillers.

    Maine Drug Laws

    Marijuana Laws in Maine
    In Maine, it is legal to possess up to 2.5 ounces of marijuana if over the age of 21. Should amounts exceed 2.5 ounces, criminal charges and jail time can result. Maine prohibits the sale of marijuana statewide and the use of any marijuana products in public places. While the fines can vary for public use of marijuana in Maine, they start at $100. It is legal to grow marijuana in Maine as long as no more than 6 mature plants or 12 immature plants are maintained privately. Growers will be required to appropriately label plants and maintain a growers license. Interestingly, marijuana can be smoked in a growing number of licensed establishments cropping up around the state. It is also legal to gift marijuana to a friend, as long as no money or services are exchanged.

    Heroin, Cocaine, and Other Drug Laws
    Being in possession of any other substance such as meth, cocaine, crack, or a prescription drug that belongs to someone else will cause serious consequences including jail time. Being in possession of opioids such as heroin, oxycodone, or the opiates could bring a class C felony and up to $5000 in fines. Other drug possession charges, also known as misdemeanors, could potentially come with $2,000 in fines and up to a year of jail time. The severity of the charges will also depend on whether or not there is a previous drug possession on record.

    Maine Drug Programs and Facilities

    Maine offers a number of different programs and facilities to help addicts to recover from their addictions. The Prevention & Harm Reduction Task Force of the Maine Opiate Collaborate is dedicated to reducing the negative effect that opioid and substance abuse has in the communities of Maine. They have many objectives including:

    • Increasing an understanding of the current drug epidemic
    • Decreasing the use of opioids by youth within the community
    • Reducing access to opioids overall
    • Decreasing the number of drug-affected babies born within the state
    • Decreasing the number of overdoses statewide
    • Decreasing the barriers that recovering addicts face when seeking sobriety

    They are also dedicated to strengthening the public health infrastructure of Maine in order to:

    • Enhance the ability of the state to prevent and reduce opioid use
    • Increase the district’s ability to prevent and reduce opioid use
